Terms of Service

These Terms of Service (“Terms”) govern the use of the services, website, and communications provided by Nailed It Roofing Plus Repair LLC (“Company,” “we,” “our,” or “us”). By using our website or engaging our services, you (“Customer,” “you,” or “your”) agree to these Terms.
1. Scope of Services
We provide roofing, repair, and related construction services. The specific scope of work, materials, pricing, and timelines will be detailed in a written contract, proposal, or estimate. Only services listed in writing are included.
2. Estimates & Changes
- Estimates are based on current labor and material costs and are subject to change.
- Final pricing may vary depending on unforeseen conditions, material cost changes, or additional work requested.
- Any alterations or deviations from the agreed scope will result in additional charges, documented in a change order.
3. Payments & Deposits
- Payment terms, deposits, and schedules are specified in your contract.
- Deposits are non-refundable once work is scheduled.
- Full payment is required upon completion unless otherwise agreed.
- Late payments may incur interest, liens on the property, and collection costs (including attorneys’ fees).
4. Customer Responsibilities
You agree to:
- Provide safe, clear, and reasonable access to the property.
- Obtain permits and approvals unless explicitly included in our contract.
- Ensure the worksite is free of hazards, pets, or obstructions.
- Maintain homeowner’s insurance.
We are not responsible for damages caused by pre-existing conditions, hidden defects, or unrelated structural issues.
5. Warranties
- Any workmanship warranty provided will be set out in your service contract.
- Manufacturer warranties apply only as issued by the manufacturer.
- Warranties do not cover: ordinary wear and tear, acts of nature (storms, floods, wind, hail, fire, etc.), misuse, neglect, or work performed by others after project completion.
6. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for incidental, consequential, indirect, or punitive damages.
- Our maximum liability for any claim is limited to the lesser of (a) the total amount paid for the specific service, or (b) the insurance coverage available.
- We are not responsible for delays caused by weather, supply shortages, government actions, or events outside our control.
7. Marketing & Communications Consent
By providing your contact information, you agree we may communicate with you by phone, text, email, or mail about services, scheduling, promotions, and updates. You may opt out of promotional messages at any time.
8. Intellectual Property & Online Content
All website content, advertising materials, photographs, and designs created by Nailed It Roofing Plus Repair LLC remain our property and may not be copied or reused without written consent.
9. Third-Party Services & Subcontractors
We may use subcontractors, vendors, or technology platforms to perform services. While we require professionalism and compliance from partners, we are not liable for independent third-party acts outside our control.
10. Dispute Resolution
- Any dispute shall first be addressed through good-faith negotiation.
- If unresolved, disputes will be governed exclusively by the laws of the state in which Nailed It Roofing Plus Repair LLC is headquartered.
- Venue for legal proceedings will be in the courts of that state.
- You waive the right to participate in class actions against us.
11. Termination of Services
We reserve the right to refuse or terminate service at any time, including but not limited to cases of non-payment, unsafe worksite conditions, or customer misconduct.
12. Indemnification
You agree to indemnify, defend, and hold harmless Nailed It Roofing Plus Repair LLC, its officers, employees, and contractors against any claims, damages, or liabilities arising out of:
- Your breach of these Terms,
- Misuse of services,
- Negligence or misconduct on your property.
13. Changes to Terms
We may update these Terms at any time. Continued use of our services after an update constitutes acceptance of the revised Terms.
